WHD Publishes Opinion Letters by the Administrator for FLSA and CCPA

Opinion Letters Published by WHD: FLSA2024-02 and CCPA2024-01

Today, the Wage and Hour Division (WHD) published two opinion letters. These letters address questions posed regarding the Fair Labor Standards Act (FLSA) and the Consumer Credit Protection Act (CCPA).


* FLSA2024-02 [ https://www.dol.gov/sites/dolgov/files/WHD/opinion-letters/FLSA/2024_12_18_01.pdf ] – In this letter, WHD addresses whether a bar owner who manages and supervises bartenders the business employs can participate in a tip pool with the bartenders.
* CCPA2024-01 [ https://www.dol.gov/sites/dolgov/files/WHD/opinion-letters/CCPA/2024_12_18_1_CCPA.pdf ] – In this opinion letter, WHD explains whether payments and reimbursements to employees pursuant to an employer-provided educational assistance program constitute earnings for purposes of applying the CCPA limitations on wage garnishment.
