It is the duty of a responsive government to provide clear and consistent guidance to the public we serve. In that spirit, the Employee Benefit Security Administration (EBSA) is modernizing its opinion letter program and encourages submissions from the public.

The agency will increase official guidance on how job-based employee benefits laws apply to specific situations. Opinion letters offer practical, common-sense answers to help employers, workers, and legal professionals understand their obligations and rights. We are committed to providing compliance assistance and meaningful outreach to job creators, workers, industry leaders and the public at large.

The agency is modernizing its multi-pronged approach, balancing outreach and education and rigorous enforcement with robust and relevant compliance assistance. Compliance assistance, including the publication of opinion letters, is a vital part of that effort. In the weeks and months ahead, you can expect opinion letters to provide guidance on the laws the agency enforces.
