*CMS Electronic Prescribing for Controlled Substances (EPCS) **Program*
*1. Announcement — CY2025 PFS Final Rule Released*
*2. Reminder — CMS EPCS Prescriber Portal Open and Measurement Year 2023 Waiver Application Period Ending November 18*
*CMS EPCS Policy in the CY 2025 PFS Final Rule*
On November 1, 2024, the Centers for Medicare & Medicaid Services (CMS) released the Calendar Year (CY) 2025 Physician Fee Schedule (PFS) final rule [ https://www.federalregister.gov/public-inspection/2024-25382/medicare-and-medicaid-programs-calendar-year-2025-payment-policies-under-the-physician-fee-schedule ], which includes policies for the CMS EPCS Program for the 2025 measurement year (MY) and beyond. CMS will publish this rule in the Federal Register on December 9, 2024.
In the rule, CMS finalized the CMS EPCS Program policy that prescriptions written for a beneficiary in a long-term care (LTC) facility will not be included in determining compliance until January 1, 2028. CMS also finalized that compliance actions against prescribers who do not meet the compliance threshold based on prescriptions written for a beneficiary in an LTC facility will start measurement year 2028.
For information on CMS EPCS Program policies in previous final rules, review the EPCS Regulatory Milestones document [ https://www.cms.gov/files/document/epcs-regulatory-milestones.pdf-1 ].
*CMS EPCS Prescriber Portal Open for Checking Measurement Year 2023 Compliance Status*
For the 2023 measurement year, prescribers still have time to check their compliance status and submit a waiver application, if needed, on the CMS EPCS Prescriber Portal [ https://cqr.cms.gov/epcs/landing ].
If you haven’t done so already, please log in to the CMS EPCS Prescriber Portal using your Health Care Quality Information Systems (HCQIS) Access Roles and Profile (HARP) ID and password to review your status and see if it’s appropriate for you to submit a waiver application.
*Need a HARP account?*
To sign up for a HARP account, visit the Create an Account webpage [ https://harp.cms.gov/register/profile-info ]. Signing up is simple and takes only a few minutes. Just enter your information to verify your identity.
For more on setting up an account, visit the HARP Help webpage [ https://harp.cms.gov/login/help ].
*Measurement Year 2023 Compliance Status*
The CMS EPCS Prescriber Portal is designed to present prescribers with their compliance status. To learn more about compliance determination, visit the “Compliance Overview” section of the CMS EPCS Program webpage [ https://www.cms.gov/medicare/e-health/eprescribing/cms-eprescribing-for-controlled-substances-program ].
For measurement year 2023, CMS sent informational notices to prescribers who met the compliance only due to the declared national public health emergency [ https://aspr.hhs.gov/legal/PHE/Pages/default.aspx ]. CMS sent the notices through email when possible and as a physical letter if there was no email address for the prescriber in the Provider Enrollment, Chain, and Ownership System (PECOS) or in the National Plan and Provider Enumeration System (NPPES). CMS encourages prescribers to update their email and mailing addresses to ensure timely receipt of the notices and therefore the opportunity to submit a waiver application to become compliant. A prescriber’s non-compliance under the CMS EPCS Program may be considered in CMS processes for assessing potential fraud, waste, and abuse. Prescriber addresses are also used to determine who qualifies for the automatic declared disaster exception.
*Measurement Year 2023 Waiver Application Period *
*Ending November 18*
Prescribers who met the program compliance for measurement year 2023 only due to the declared national public health emergency [ https://aspr.hhs.gov/legal/PHE/Pages/default.aspx ] have the option to submit a waiver application for additional extraordinary circumstances, such as technological limitations or other circumstances outside of their control.
*The application submission period is open now but will close Monday, November 18, at 8 p.m. ET.*
For more on submitting an application, read the CMS EPCS Program Waiver Application Fact Sheet [ https://www.cms.gov/files/document/waiver-application-quick-reference-guide.pdf ].
*CMS EPCS Program Support*
CMS is committed to providing support and resources to prescribers included in the CMS EPCS Program:
* The CMS EPCS Program webpage [ https://www.cms.gov/medicare/e-health/eprescribing/cms-eprescribing-for-controlled-substances-program ] is the centralized location for program resources and updates.
