WHD Publishes Opinion Letters by the Administrator for FLSA and FMLA

Opinion Letters Published by WHD: FLSA2025-1 and FMLA2025-1-A

Today, the Wage and Hour Division (WHD) published two opinion letters. These letters address section 3(m)(2)(B) of the Fair Labor Standards Act (FLSA) and Family Medical Leave Act (FMLA) regulations.


* FLSA2025-1 [ https://www.dol.gov/sites/dolgov/files/WHD/opinion-letters/FLSA/2025_1_14_1_FLSA.pdf ] - Whether a manager or supervisor under section 3(m)(2)(B) of the FLSA can receive tips from a tip pool when working in a non-supervisory capacity.  

* FMLA2025-1-A [ https://www.dol.gov/sites/dolgov/files/WHD/opinion-letters/FMLA/2025_1_14_1_FMLA.pdf ] - Whether the Family and Medical Leave Act regulations pertaining to substitution of paid leave apply when employees take leave under state or local paid family leave programs.
